1) ACCEPTANCE OF TERMS

AwardWallet, LLC, owner and operator of AwardWallet.com, provider of the AwardWallet.com service to User is subject to the following Terms of Use. AwardWallet, LLC reserves the right to update the Terms of Use at any time without notice to User. a) By using AwardWallet.com, other than for purposes of reading this Agreement or the Privacy Policy, User agrees to comply with all of the terms and conditions hereof. The right to use AwardWallet.com is personal to User and is not transferable to any other person or entity. User is responsible for all use of User's Account and for ensuring that all use of User's Account complies fully with the provisions of this Agreement. User shall be responsible for protecting the confidentiality of User's password.

b) AwardWallet, LLC shall have the right at any time to change or discontinue any aspect or feature of AwardWallet.com.

c) All trademarks, service marks and brands of third parties referenced herein are the property of their respective owners. All trademarks remain the property of their respective holders, and are used by AwardWallet only to directly describe the services being provided. Their use in no way indicates any relationship between AwardWallet and the holders of said trademarks.

2) CHANGED TERMS

AwardWallet, LLC shall have the right at any time to change or modify the terms and conditions applicable to User's use of AwardWalllet.com or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on AwardWallet.com or by electronic or conventional mail, or by any other means by which User obtains notice thereof. Any use of AwardWallet.com by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.

3) DESCRIPTION OF SERVICES

AwardWallet.com provides travel information, award program point aggregation and other travel and award related information. Award balance information, travel itineraries, travel or award information and any calculations or aggregations based on such information are provided for informational purposes only.  AwardWallet, LLC shall not be liable for any errors or delays in the content, information, data, or aggregations users may receive relative thereto or for any actions taken in reliance thereon.

4) USE OF USER DATA AND ACCOUNT INFORMATION

AwardWallet.com will retrieve information from third party websites on your behalf in order to create a consolidated report consisting of incentive program award points and credits, travel itineraries and other related travel information. The consolidated reports will be presented for your sole use and in a format determined by AwardWallet.com. We are not responsible for the content of linked third-party sites, and do not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. AwardWallet.com assumes no responsibility for and disclaims any liability for acts, omissions or determinations by any program sponsor or third party websites. AwardWallet.com has no relationship to, or connection with, any airline, hotel, or other frequent traveler program sponsor unless specifically mentioned.  AwardWallet, LLC may use your information in order to enhance, configure and customize the AwardWallet.com service and information displayed for your use on the AwardWallet.com website.

Your account will remain active until one of the following condition occur: (1) You decide to cancel your membership (2) There is no activity for a period of 6 months (3) AwardWallet.com ceases its operations (4) AwardWallet.com determines that it is no longer able to provide service for free.

5) USE OF WEB SITE, FORUMS, POSTS, BLOGS AND SOCIAL NETWORKING FEATURES

NEITHER AwardWallet, LLC, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT AWARDWALLET.COM WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF AWARDWALLET.COM, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH AWARDWALLET.COM

B) AWARDWALLET.COM IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

C) USER EXPRESSLY AGREES THAT WHILE AWARDWALLET.COM MAY SHOW AWARD EXPIRATION DATES IT IS USER’S RESPONSIBILITY TO VERIFY EXPIRATION DATES DIRECTLY WITH THE PROVIDER OF MILES / POINTS AND IN CASE IF ANY REWARDS ARE LOST AS A RESULT OF INACCURATE EXPIRATION DATE REPORTED BY AWARDWALLET OR ANY OTHER REASON, AWARDWALLET.COM IS NOT LIABLE FOR SUCH LOSS IN ANY WAY.

D) WHILE AWARDWALLET.COM GATHERS USER ITINERARIES AND NOTIFIES USERS OF FLIGHT DEPARTURE TIMES AWARDWALLET IS NOT RESPONSIBLE FOR MISSED FLIGHTS DUE TO INACCURATELY REPORTED DATES OR TIMES OF SUCH FLIGHTS. USERS ARE RESPONSIBLE TO VERIFY ITINERARY DETAILS DIRECTLY WITH THE PROVIDERS SUCH AS AIRLINES, HOTELS, RENTAL CARS, ETC.

E) AWARDWALLET, LLC IS NOT RESPONSIBLE OR LIABLE FOR 1) MALICIOUS CODE, DELAYS, INACCURACIES, ERRORS, OMISSIONS, CHANGES IN FEES, MISTAKES OR OMISSIONS ARISING OUT OF YOUR USE OF AWARD WALLET.COM, AwardWallet, LLC’S MODIFICATION OF ANY RESERVATION ON YOUR BEHALF, OR ANY SITES LINKED TO AWARDWALLLET.COM, OR 2) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN.  YOU FURTHER UNDERSTAND AND AGREE THAT IN THE EVENT WE MODIFY A RESERVATION ON YOUR BEHALF, THE RESERVATION MAY BE SUBSEQUENTLY CANCELED OR CHANGED BY THE APPLICABLE THIRD PARTY TRAVEL PROVIDER WITHOUT NOTICE.  YOU UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER  AWARDWALLET, LLC, OR ITS SUCCESSORS AND ASSIGNS, NOR ANY OF ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES, SERVICE PROVIDERS, ADVERTISERS, OR SUPPLIERS, SHALL BE LIABLE FOR ANY LOSS OR DAMAGE, OF ANY KIND, DIRECT OR INDIRECT, IN CONNECTION WITH OR ARISING FROM USE OF THE AWARDWALLET.COM WEBSITE, INCLUDING  AWARDWALLET LLC’S MODIFICATION OF ANY RESERVATION ON YOUR BEHALF AND/OR  AWARDWALLET LLC’S NEGLIGENCE, INCLUDING, BUT NOT LIMITED TO, COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
